范律师专栏: CIS H-1B内部调查文件
今天AILA 公布CIS内部的一份Work Sheet，这份是用来评估什么样的H-1B申请是可能受到调查的Work Sheet。CIS有一个自己评分的标准，有几项在Work Sheet里我想值得注意:
1．Contracts for consultants or staffing agencies show no end-clients-no work description or itinerary.
2．Suspect documents: altered, counterfeit, or boilerplates etc.(i.e. all employment letter have virtually same text and signatures with letterhead being the only difference).
3．Multiple filings (非一人申请多个H-1B，而是公司向CIS说每年申请的数目与记录不符)。
4．No website for an IT consulting company: also be aware of websites that look good but are always under construction.
5．Preparer and preparer’s address: the preparer, notary, petitioner, etc, are the same person and they have the same address while the actual work locations shows a difference address.
6．Occupations-Accounting, Human Resources, Analysts & Managers(i.e. Marketing Research Analysts, Business Analysts, Financial Analysts, Manager for advertising, Marketing, Promotions, Public Relations and Sales requested by marginal companies lacking the organizational complexity required to support the position on a full-time…
我们可以看出CIS注意的针对对象是一些consulting firm，及accounting, marketing, business这方面的职位。如果公司不大，但却要求上列的职位比较容易受到CIS的刁难。这种现象尤其在CA Service Center特别的多。有时候连国际大公司的accounting, marketing职位都被CA刁难，甚至否决。而且这些否决的原因都是一模一样，可以得知这是Service Center的政策问题，所以申请人在这方面一定要小心。
很多人问找一个朋友的公司，或是consulting firm 先申请H1B可不可以。这方面已经被CIS注意，进来有一些这方面的案子出现。我们一贯的答案是你一定要10月1日后上班领薪水，否则除了H1B不能生效，也有法律上的问题。
今年因为经济不好，我们猜想CIS可能会比往年更加挑剔。
