I-140被取消身份为何
I had been in F1 until December 2004. Before the end of last Fall semester Ifiled for the transfer of F1 to H4 while my spouse and asked for H1 extensionfor the 7th year based on the approved I-140 got through his former employer.
Unfortunately, we received a RFE from USCIS last week, informing us that I-140had been revoked. Now though he has a pending LC filed by his currentemployer, but it is far from the 365 days requirement for extending H1B forthe 7th year.
Does his case have any hope? Am I already out of status (I did not registerthis spring)? Is there anything we can do other that going back to China ?
这个问题要从不同的角度回答。第一，提出I-140有否申请I-485。如果有申请I-485，而且超过六个月，一般I-140是无法取消的。除非申请人没有申请I-485(因为优先日期未到)即便I-140提出超过六个月，AC21也不适用于此。
因为申请人的第七年H-1B是借著之前的I-140所提出的(AC21对因为该国名额来到的人，可因此延期)。但是因为现在I-140被取消，所以AC21对他的保护也因此消失。连带着H-1B的第七年也就在I-140被取消时立即停止。我们并不知道I-140取消的原因为何，所以无法做进一步的分析，该申请人既然已经转到别的公司，后来又办新的LC，很明显的，之前的I-140已经不保，因为当时I-140还没有被取消，所以H-1B的第七年还是有效。到如今恐怕什么办法都没有。
