2010年十月批准的EB-1A与EB-1B申请及专业背景
This report includes eight (8) EB-1A and EB-1B I-140 cases filed by Liu & Associates and approved by the USCIS in October 2010. In the past few months, USCIS adjudication of I-140 cases has been significantly slowing down. As a result, we had fewer I-140 cases approved in October than in a regular month. Also, as a result, a large number of I-140 cases have been pending over four (4) months, the USCIS posted processing time for I-140 petitions. Recently we have received numerous inquiries in regard to the USCIS Interim Memorandum following Kazarian and whether USCIS has raised the bar for EB-1Aand EB-1B petitions. So far, we have not seen a clear trend of change or USCIS policy shift regarding EB-1A and EB-1B adjudication. In October, we had eight (8) EB-1A and EB-1B cases approved, and no EB-1A or EB-1B case wasdenied by USCIS. In the past ten (10) months of 2010, our office has had 221 EB-1A, EB-1B and NIW I-140 cases approved by USCIS. Among these approved cases, fifty-one (51) were EB-1A, forty-six (46) were EB-1B, and 124 were NIW. So far this year, we have had seven (7) I-140 cases denied by USCIS. Among the denied I-140 cases, one (1) was EB-1A, six (6) were NIW, and none were Eb-1B. Most of the denied NIW I-140 cases were transferred from TSC to NSC and denied by NSC in January and February. Some of the denied NIW I-140 cases were already approved in TSC through re-filing. Notably the only denied EB-1A I-140 case was a fairly strong EB-1A petition denied by the TSC Premium Processing Service in August. Lawyers from the American Immigration Lawyers Association (AILA) have complained about the troubling premium processing of EB-1A, and we strongly warn our clients against requesting premium processing for their EB-1A cases. Here we list the basic credentials of each EB-1A and EB-1B case approved by USCIS in October and hope our readers find the information helpful. For confidentiality purpose, a numeric number is assigned to replace the petitioner/beneficiary’s name in each case. It is our firm’s policy to hold client’s Information strictly confidential.
