The state of Arizona, which shares a long border with Mexico, has just passed a strict new immigration law. Under the law, police are asked to investigate the legal immigration status of anyone who reasonably appears to be in the United States illegally. Essentially, the law makes failure to prove of citizenship or legal status a crime, and any immigrants who can’t ultimately produce documentation can be arrested, fined $2,500 and jailed for up to six months.

This law is very controversial. For many Americans, giving police the right to demand identity papers based on suspicion alone violates traditional American values. Since American society is composed of ethnic groups from around the world, even native born Americans who appear foreign may be asked under the law to prove that they are here legally. Many immigration experts and civil rights leaders have protested the new law, and President Obama has asked the Justice Department to investigate whether it is constitutional.

However, the law’s austerity reflects the seriousness of Arizona’s illegal immigration problem. One in eleven people in Arizona is an illegal immigrant. Many illegal immigrants, primarily coming across the Mexican border, work and live in an underground economy that consumes state resources for health, law enforcement, and social services. Moreover, illegal immigrants can be easy targets for criminals or economic abuses. For these reasons, despite the controversy, a majority of Arizona citizens are in favor of the new law.

America enthusiastically welcomes legal immigration, but strongly opposes illegal immigration. More states may begin to adopt stricter immigration laws, and many experts expect comprehensive immigration legislation from Congress in the coming year (after November elections). In addition, enforcement of current immigration laws is likely to become more aggressive. For foreigners planning to come to the United States, and for those already here, these developments underscore the importance of maintaining legal status and keeping abreast of the laws. Your lawyer can answer any questions you have about the dynamic legal landscape of American immigration law.
